Renovation & demolition — federal NESHAP

When to check: Before disturbing building materials or demolishing a covered facility.

Covered projects require an asbestos inspection. Covered demolitions require advance notification; renovation notifications depend on the materials and quantities involved. Work practices and waste handling also matter. Small residential exclusions have limits, including homes that are part of a larger commercial or public project. Local air rules can be broader.

Worker protection — Cal/OSHA

When to check: Construction, repair, maintenance, or other covered work involving asbestos exposure.

California’s construction standard addresses identifying materials, exposure assessment, training, controlled work areas, protective equipment, and communication with building owners and other employers. An air-district exemption does not establish an exemption from worker-protection rules.

Qualifications & separate work notifications

When to check: Hiring a consultant or planning asbestos-related work.

Check the California consultant certification and contractor registration requirements for the scope. Cal/OSHA has its own work-notification requirements, separate from air-district notices. A consultant can help connect the survey, work plan, and clearance scope.

Schools — AHERA

When to check: Public and nonprofit private elementary and secondary schools.

School asbestos obligations include inspections, management plans, periodic surveillance, reinspection, trained personnel, and notifications. These ongoing responsibilities are additional to renovation and demolition requirements.

Occupied commercial & public buildings

When to check: Managing an older building with known asbestos-containing construction materials.

California has asbestos-information requirements for occupants of covered public and commercial buildings constructed before 1979. Review the owner’s duties and applicable exclusions, as well as the separate Cal/OSHA duties to communicate with workers and tenants.

Soil, rock & naturally occurring asbestos

When to check: Grading, excavation, or other work that may disturb asbestos-bearing soil or rock.

California has separate airborne toxic control measures for naturally occurring asbestos. Check the site conditions and the air district’s requirements before earthwork; a building-material survey does not answer this question.

Waste classification & disposal

When to check: Generating, transporting, or disposing of asbestos waste.

Determine the waste classification and the required packaging, transportation, documentation, and receiving facility. California hazardous-waste requirements and air-program requirements are separate. Confirm that the receiving facility can accept the waste.

Child care drinking water — AB 2370

When to check: A licensed child care center operates in a building constructed before January 1, 2010.

California requires lead testing at covered drinking and food-preparation outlets, with repeat testing at least every five years. Initial deadlines depend on licensing history. Results at or above 5.5 Parts per billion (ppb)A concentration unit used in lead-in-water reporting. A number only makes sense with the sample, method, and applicable comparison criteria. require immediate action under CDSS guidance. This center-testing mandate does not apply to family child care homes.

Renovation, repair & painting — EPA RRP

When to check: Paid paint-disturbing work in most pre-1978 housing and child-occupied facilities.

Covered work generally requires an EPA-certified firm, a certified renovator, lead-safe work practices, and occupant information. Exceptions have conditions. A child-occupied facility can be within a commercial or public building; RRP is not a blanket rule for every commercial property.

Evaluation, clearance & abatement — CDPH

When to check: Lead hazard evaluations and lead abatement in residential and public buildings.

Use professionals whose CDPH certification covers the task. California’s public-building category includes many commercial properties. Review the applicable evaluation, work-practice, reporting, and abatement-notification requirements. Renovation certification and lead-abatement certification serve different purposes.

Worker exposure — Cal/OSHA

When to check: Employees may encounter lead during construction or other covered work.

Employers must assess and control employee exposure. Training, exposure monitoring, protective measures, and certain work notifications may be required. These duties can apply to residential, commercial, public, and industrial projects of any building age. General-industry operations have a separate standard.

Lead hazards & local enforcement

When to check: Deteriorating paint, contaminated dust or soil, or an agency notice affects the property.

California lead-hazard and housing requirements can involve local health, housing, and building agencies. Contact the agency serving the actual city or unincorporated area. A local lead-prevention program is a public-health resource; it does not replace the building-permit authority.

Federally assisted housing — HUD

When to check: A pre-1978 housing project receives federal assistance or involves covered federal property.

The Lead Safe Housing Rule can add evaluation, hazard reduction, notification, and clearance requirements. The applicable provisions depend on the program, activity, assistance, and exemptions. Confirm them with the administering housing agency.

Waste classification & disposal

When to check: Removing painted materials, lead-contaminated dust, soil, or debris.

Determine how each waste stream must be classified, contained, transported, and disposed of. The rules depend on the waste and generator; a paint test alone is not necessarily a complete waste determination. Confirm the receiving facility and the appropriate local waste regulator.

03 / Confirm before work starts

Bring the right details.

Have the project address, building use and age, proposed work, and any existing survey or test results ready. Ask the responsible agencies to confirm notices, permits, qualifications, and disposal requirements.

For city permits, start with the city; for an unincorporated property, start with the county. Hospitals, tribal land, and other special jurisdictions may involve different authorities.
